1. Agreement
These Terms govern your use of HVAC-R Technician Jobs Canada at hvacrtechjobs.com (the "Service"), operated by RC Squared Inc ("we," "us"). By creating an account, posting a job, or applying to a job, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service is, and is not
HVAC-R Technician Jobs Canada is an online platform that lets employers post job listings and lets candidates apply to them. We are not an employer, employment agency, or staffing firm, and we are not a party to any hiring relationship. We do not employ candidates, do not supervise or control employers' hiring, and are not responsible for the conduct, decisions, postings, or content of any employer or candidate. Any hiring, offer, contract, or payment for work is solely between the employer and the candidate.
3. No guarantees
We provide the platform "as is." We do not guarantee that a candidate will receive any job, interview, offer, or response, that an employer will receive any applicants or suitable applicants, that any listing will produce results, or that the Service will be uninterrupted or error-free. Job listings are created by employers, and we do not verify, endorse, or guarantee the accuracy, legality, or legitimacy of any listing or any applicant's information.
4. Accounts
You must provide accurate information, keep your login credentials secure, and be responsible for activity under your account. You must be of legal working age in your province. We may suspend or close accounts that violate these Terms.
5. Employers: postings and payment
- Paid postings. Posting a job requires a paid package purchased through the Service. Prices are shown at checkout. Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms.
- Refunds. You may request a full refund within 48 hours of purchase if no applications have been received for your listing. After 48 hours, or if any applications have been received, fees are non-refundable except as required by law or as otherwise stated at purchase.
- Account required. Employers must hold an account to purchase and post, so that each listing has an identified owner who can manage it and receive applications.
- Your content. You are responsible for the content of your listings. You must have the right to post the role, and your listings must be lawful, accurate, non-discriminatory, and for genuine job openings. You must not post on behalf of another business without authority, post the same role to mislead, or collect applicant data for any purpose other than hiring for the posted role.
- Applicant data. Applications and resumes you receive are provided for the sole purpose of evaluating candidates for the posted role. You must handle applicant personal information in accordance with applicable privacy law and must not repurpose, resell, or further disclose it.
- Our rights. We may review, decline, edit the placement of, or remove any listing at our discretion, including listings that breach these Terms, without obligation to refund where removal results from your breach.
6. Candidates
You must provide accurate information in your profile and applications, apply only for roles you are genuinely interested in, and not misrepresent your identity or qualifications. Your control over your resume and consents is described in the Privacy Policy.
7. Acceptable use
You must not misuse the Service, including by: posting unlawful, fraudulent, infringing, or harmful content; harvesting or scraping data; attempting to access accounts or data that are not yours; uploading malware; or interfering with the Service's operation or security.
8. Intellectual property
The Service, including its design, templates, and content we provide, is owned by us or our licensors. Employers and candidates retain ownership of the content they submit and grant us a limited licence to host and display it as needed to operate the Service.
9. Privacy
Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost opportunities, or hiring or employment outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your content, your use of the Service, or your breach of these Terms or of any law or third-party right.
12. Termination
You may close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or its users. Provisions that by their nature should survive (including sections 2, 3, 8, 10, and 11) survive termination.
13. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of British Columbia have jurisdiction, subject to any non-waivable consumer rights you have where you live.
14. Changes
We may update these Terms. Material changes will be posted here with a new date. Continued use after changes means you accept them.
